Nevada Supreme Court rules in favor of state Pharmacy Board
CARSON CITY, Nev. Under a ruling by the Nevada Supreme Court, the state Pharmacy Board can punish a drug wholesaler that breaks the law regardless of its intent.
The board had accused Dutchess Business Services and Legend Pharmaceuticals, its successor company, of purchasing and selling adulterated and misbranded prescription drugs, improper recording practices and purchasing drugs from companies not authorized to distribute drugs.
On the other hand, the court ordered the board to lower fines against the two companies and also said that Dutchess had not violated the law by doing business with a company that had been exempt from the state’s licensing laws at the time.
