Warner Chilcott subsidiary files patent infringement suit
HAMILTON, Bermuda A drug maker has filed a patent infringement suit against a generic drug company over its generic version of an antibiotic used to treat acne.
Warner Chilcott announced that Mayne Pharma International, one of its subsidiaries, had filed a lawsuit against Mylan in the District Court for the District of New Jersey for infringement of the ‘161 patent for Doryx (doxycycline) delayed-release tablets in the 150 mg strength. The lawsuit is in response to Mylan’s filing for regulatory approval for a generic version of Doryx before the 2022 expiration of the ‘161 patent.
Warner Chilcott markets Doryx delayed-release tablets in the 75 mg, 100 mg and 150 mg strengths under a license agreement with Mayne.
